1.1 什么是酒驾

Drink driving is the crime or offense of driving or operating a motor vehicle while impaired by alcohol or other drugs (including recreational drugs and those prescribed by physicians), to a level that renders the driver incapable of operating a motor vehicle safely.

1.2酒驾所面临的处罚

Those caught driving with a Blood Alcohol Concentration (BAC) over the legal limit face heavy fines, loss of licence and, for the most serious offenders, possible imprisonment.

1.3防止酒驾的措施

• Alcohol interlock device 酒精检测联锁(装置)

It is a breathalyzer for an individual's vehicle. It requires the driver to blow into a mouthpiece on the device before starting or continuing to operate the vehicle. If the resultant breath-alcohol concentration analyzed result is greater than the programmed blood alcohol concentration (which varies between countries), the device prevents the engine from being started. The interlock device is located inside the vehicle, near the driver’s seat, and is directly connected to the engine’s ignition system.

A police vehicle used for administering blood-alcohol tests (to drivers), generally a mid-size bus converted or fitted out for the purpose

2.1 什么是超速驾驶

Drivers and riders can both be fined or receive demerit points if caught travelling over the speed limit. For excessive speeding, you may face harsher penalties like licence cancellation or suspension and vehicle impoundment or immobilization.

The following road rules and reference numbers regarding speed limits are outlined in full within the Road Safety Road Rules 2017.

2.3 超速驾驶的处罚

3.1 什么是肇事逃逸

Hit and runs include any accident where a vehicle hits a person, object, or vehicle and the driver knowingly leaves the scene without providing their information. There is an exception for property and vehicular accidents if no one is around. If you leave your information and file a police report, it’s not a hit and run—even though you leave the scene.

3.2肇事逃逸的处罚

• Fines

The magistrate may give you a fine for these offences. You can get:

five penalty units for a first offence

ten penalty units for a second offence.

•Losing your licence

For any one of these offences, magistrates usually suspend your licence for one to six months. You must not drive at all during this time. There are no exceptions.


•Jail

The magistrate may order imprisonment:

14 days for a first offence

1 month for subsequent offences

 Driving without a licence

4.1 什么是无证驾驶

Driving unlicensed in Victoria, is an offence. If you drive without a valid licence, you could be fined, be prohibited from applying for a licence for a period of time, and/or ordered to serve a term of imprisonment. The court can also make other types of orders, including vehicle immobilisation or community work.

Unlicensed driving includes the following categories:
Drivers who never obtained a licence or whose licence has expired

Drivers who have had an existing licence suspended or cancelled

Drivers who have been disqualified from obtaining a licence
被取消取得驾驶执照资格的司机
Drivers who are in breach of any condition of their licence

4.2无证驾驶的处罚(以维州为例)

Driving without a valid licence: If your licence has lapsed or you are disqualified from holding a licence you could face a fine of up to $9,500 or six months in jail. The same penalty applies for allowing an unlicensed driver to drive your car.

If you have previously held a Victorian licence or interstate licence and it was not cancelled for road-related reasons, then the penalties are less severe, with fines up to $1470 and up to one month in jail.

Driving with a disqualified or suspended licence: If you are unlicensed and would have had an alcohol-interlock order imposed had you applied for a licence, you could be fined up to $38,000 or two years in jail. The same applies to suspended licences.

Fully qualified drivers over the age of 26 don't have to carry their licences on them. Learner drivers do, and failing to produce it on demand is a $155 fine.
