尊敬的总理和移民部长,您们好!
我们是一批已经获得永久居留权或已经提交永久居留申请材料的中国移民,正处于被赋予永久居留权或成为澳洲新公民的满怀希望的等待阶段。然而拟议中即将推出的入籍立法和相关的福利政策的巨大变化却像是泼在我们头上的一盆冰水。作为当事人我们深感新政的严重不公,并为此表达我们的强烈抗议。
澳大利亚的美丽富饶,地大物博,环境优美,尤其是其民主自由的价值,多元文化,多姿多彩的社会以及持续稳定繁荣发展的经济使她成为我们真心向往的国度。在澳洲政府推出的鼓励和欢迎成功商业人士移民澳洲创业发展的政策驱动下我们满怀希望和信心来到澳洲建设我们新的家园并为澳洲的发展作出贡献。为此,我们中大多数人放弃了我们在中国已经颇有成就的职业生涯或收益颇丰的生意活动,离开我们原有的家园来到澳大利亚以期开创新更加美好的事业和过上更为自由幸福的生活。
由于语言和文化上的差异,在澳洲的开局其实充满了种种当地人难以想象的艰难困苦。然而,坚定的愿望和信心让我们在开局的几年中克服了困难的阻力重新发展了起来。在这个过程中我们更多地了解了澳洲,并深切体会了澳大利亚社会自由,民主,公平,正义,包容,相互尊重和共同繁荣的价值观,爱上了这里的一草一木,山山水水。我们关心周围社区发生的一切,积极地参与各种活动,尽最大努力融入到澳大利亚的社会中。不仅如此我们还捐钱捐物给慈善机构和救世军帮助有困难的群体。我们实际上已经成为了澳州社会的一部分,在我们的感情上我们已经是一个澳大利亚人。我们为此感到骄傲和自豪。我们努力工作,依法按时纳税,过着丰富多彩的生活,成为社会的好榜样。我们期望着早日成为澳洲公民以便我们全身心的投入到这个国家的繁荣发展和新家园的建设中去。
然而,拟议中的新的移民政策却要将这美好的一切毁于一旦,将很多人成为澳大利亚公民的梦想变成为泡影。正如许多舆论和有识之士质疑的那样新政策的合理性是十分值得怀疑的。雅思门门6分的英语水平要求对于母语非英语,专业亦非英语的绝大多数成年人来说几乎就是不可企及的目标。正如联邦参议员Penny Wong所说即便是国会议员也未必都能达标,更不要说是普通澳洲人。事实上绝大多数在澳洲发展十分成功的第一代移民他们的英语水平也远远不及6分。换言之,这样高的要求是根本没有必要的。提出这样的要求透露出的是对于新移民非英语文化背景的歧视,是与多元文化精神相背离的,是一种可耻的倒退。尤其是对于我们这些现行政策条件下的申请人,这是极其不负责任的简直就是一个骗局。
我们大多数人在中国的各个领域已经取得骄人的成功。现行移民政策量体裁衣吸引我们来澳创业发展,促使我们放弃了我们在中国的生活和家庭,举家来到了澳大利亚。就在我们创业有成,已经融入澳洲按现行政策即将入籍之时,拟议中的新政却无视我们的辛勤努力让我们即将成功的奋斗很有可能成为噩梦。我们有些人已是中年人,我们在澳洲期间已经学会了不少基本日常交流用英语,然而英语作为我们的第二语言,要得到雅思6分是既不现实也无必要的。
将PR到公民的等待期由现在的1年大大延长为4年,新政策透露出现政府对新移民的傲慢和冷漠。这与之前对投资移民的吸引和欢迎政策形成了鲜明的对比。暴露出的是移民政策上严重的不连续性,这势必在移民事务方面由此造成混乱。更为严重的是它的实施必将造成澳洲社会政治和经济上的严重不公。首先,在新移民最需要在政治上学习和参加澳洲民主制度国家治理事务的时候,新政策制造了一种法理上的隔阂和公民权力上的歧视。事实上这样的歧视只会给新移民融入澳洲社会的努力造成额外的阻碍和心理上的负面影响。在经济上公民等待期的PR持有人将像其他澳洲人一样工作纳税,可他们及其家庭却不能像他们的澳洲同事一样享受全民医疗保险,尤其子女不能像他们的澳洲伙伴那样获得法定的免费中小学教育。而这些我们及子女本来在中国都是完全享有的。在新的国度重建家园往往是一个家庭最艰难的时期。新的移民政策却有意对这些新居民制作经济上的困难。作为主权国家澳洲有权选择给予什么人PR,重要的是把好PR授予关,而不是对已经授予了PR的移民进行长年的政治歧视和经济弱化。这最终会对他们及其家人融入澳洲的努力和今后的发展造成难以估量的损害。或许它可以节省政府部分福利开支,可从长远来看却很可能是得不偿失的。
我们这些在现政策下申请或已获得PR的移民已经用事实证明我们已成功地在澳洲开辟了新的事业和美好生活。如果用条件过度苛刻的新政策阻止我们成为澳洲公民,我们就将长年成为澳洲的二等居民,那么移民政策中的公平与正义何在?澳洲社会的平等,包容,相互尊重,相互帮助和支持的不就成了空洞的口号吗?现政策让我们义无反顾的举家来到澳洲,如今又要用过于苛刻的新政策把我们变成二等居民,这实际上与背信弃义无异。如果当初是这样的政策我们肯定不会来做这种无益的努力。 新法溯旧案,在伤害整个PR群体的利益和士气的同时,也必将会影响澳洲政府的国际声誉,让有移居打算的人群疑虑不前。
为了我们的正当利益,也为澳洲的未来,我们向您呼吁,Turnbull先生,请您和移民部长重新考虑新的公民法和其他政策的大幅度调整的合理性。并强烈要求政府移民部遵循法不溯旧的原则!谢谢!
Respectable Prime Minister and Minister of Immigration,
We are a group of Chinese immigration applicants who either have been granted Perminant Recidency (PR) or have just lodged PR application to Immigration Department. We are at the stage of being granted PR or hopefully soon to become Australian citizens. But the proposed huge changes in Australian citizenship regulations and the relevant social welfare policy are just like a bucket of icy water poured on to our heads. As people concerned by the new policy, we deeply sensed its injustice, and we have to express our strong protest against this policy!
Australia is a great beautiful country with rich reservation of nature resources and unique environment. Its political freedom and democracy value, multiculturalism, colorful life style and sustainable economic development make Australia a highly sought after immigration target country. Encouraged by the current immigration policy which attracts and welcomes the successful business people to migrate to Australia, we came and settled down with great hope and faith to build our new home and to contribute to the development of Australia. Because of this, most of us have given up our already successful career or well established business, and left our families back in China, came to Australia expecting that we can create a better career or more successful business and live a free and happier life here.
Because of the differences in language and culture, our beginnings here were actually full of unimaginable difficulties and hardship. However, our unshakable hope and faith helped us overcome all sorts of barriers and difficulties and re-established everything here again. Such experiences also greatly deepened our understand of Australia, not just the land and the people, but the true values of freedom, democracy, equality, justice, inclusive, mutual respect and the common wealth as well. We love this country, her soil, her water, her mountain and her coast. We care our neighbourhood community, attended all sorts of events organized by not just the Chinese communities, but mainstream organisations as well. We also donate money or material to Salvation Army to help poor people or to Charity funds when our people are suffering from nature disasters now and then. As a matter of fact, we have already become part of Australian society, and we already feel like an Australian. We work hard, perhaps harder than most Australians, we pay tax and we live a busy but colourful life, hope to be a role model for the society. We just sincerely wish to become completed Australian citizen to take part in the joint effort to build a greater and prosperous Australia.
However, the proposed new immigration policy is going to destroy all these beautiful wishes and efforts, making a lot of people’s Australian citizen dream vanish straight away. As criticized by most medias and people of insight, the rationality of the new policy is quite doubtful. IELTS 6 points for reading, writing, listening and speaking is hardly possible/achievable for adults of non-English native speaker, or not specialized in English. "If English grammar is the test, there might be a few members of parliament that may struggle," said Senator Wong. It’s certainly the case for average Australians! In fact, most of non-English speaking immigrants who have achieved greatly after came to Australia didn’t have proficiency in English when they first came, and perhaps still can’t get 6 points after years even decades here. In another words, such high English proficiency requests is not necessity at all. Emphasizing such a high language criteria actually exposes a hidden discrimination against immigrants of non-English speaking background. Hence it is against the spirit of multiculturalism and is a shameful fall back in the Australian immigration history. To people like us who applied immigration under the current policy, the new policy is totally irresponsible and is simply a scam.
Most of us have been already quite successful at various industries in China. The current immigration policy was tailored to attract us to come and develop in Australia, as encouraged here we came, leaving our families and friends behind. Right at the stage that we already made significant achievements, deeply indulged in our Australian way of life and hopefully or ready to become Australian citizens, the proposed new policy is no doubt a nightmare to our sacrifice, our hardship and our hope! A lot of us are or close to middle age, we already learnt a lot of useful daily communication English during our time here. As English wasn’t the language we grew up with, to get IELTS 6 points is almost an impossible mission and simply not necessary.
Increase waiting period of PR to citizenship from one year to four exposes the government’s arrogance and indifference towards new immigrants. What a sharp turn back this new policy is from the current attracting and welcome attitude?! It also exposes the serious policy discontinuity, which will inevitably cause confusion to this country’s immigration cause. What is more? Its application will produce severe political and economic inequality to Australian society. First, it creates a juristic separation and discrimination in residential rights during the very time the new immigrants need to learn Australian politics and want to take part in the country’s democratic management. This will also create extra barrier and negative psychological effect upon new immigrants to assimilate to the society in the future. From economic point of view, the PR visa holders work and pay tax as normal Australians, but they and their families are not entitled to social welfare, especially their children are not entitled for free primary and high school education as other Australian kids are, while they do have such entitlements back in China. Re-build a home in a foreign country is often the most difficult time for a family, however the new policy will simply add more hardship on top of such difficulties. As a sovereign state, Australia has the authority to grant PR to people of your selections, make the right selection is more useful than make many years of the political and economic discrimination to PR visa holders. As a result, it will cause unimaginable damage to their effort of assimilation to Australia and their later development here. It may save the government some social welfare cost, but such savings may not compensate the damage caused by the new policy.
People who were granted PR or are waiting for their PR under current policy have already proved that we have been successful in opening new business or new career here. If we are blocked to become Australian citizen because of the new harsh immigration regulation, making us the secondary class citizens, then where is the fairness and justice? The value of equality, inclusion, mutual respect, help each other and support each other would become empty slogans! The current policy attracted us and our families migrate to Australia , and now this government want to apply the harsh new policy to make us become the secondary citizens this is in fact a treachery. If the current policy is like this, we surely would not bother to make this useless effort. If new policy is applied to existing cases, it will hurt the interests of the all the PR holders and will also damage the international reputation of Australian government,
For the sake of our own interests and the future of Australia,Mr Turnbull and Mr Dutton, pleas reconsider the rationality of your new citizenship regulation and relevant policy changes, and we sincerely hope and strongly demand the proposed new immigration policy does not apply to existing cases.

Senator Wong said the citizenship test was already in English and had been largely designed by former Liberal prime minister John Howard.

本次改革重点归纳:
更严谨的公民入籍试;
拥有家庭暴力和有组织罪行历史不能入籍;
申请人要证明融入澳洲社会,例如受雇和孩子有上学;
更严格英语测试,包括读、写和听力;
申请人还必须以PR永居身份在澳大利亚居住至少4年,而非目前要求的12个月;
入籍考试不及格的次数不能超过3次,三次不通过要等两年重试。目前对入籍考试不及格没有次数限制。
“过渡期”也将植入到PR的改革中
PR的过度签证将在所有移民签证类别中全面展开实施,先持有过渡签证,符合条件后才能拿PR。
过渡签证的时间长度在2-4年不等,偏远地区2年过渡期,而像悉尼、墨尔本等非偏远地区的大城市将会是长达4年的过渡期。
过渡签证无法享受到PR的福利待遇!这也被认为是澳洲当局要减缩财政开支的重要举措!
外国人持有过度签证期间,澳洲政府将会针对税务和居住情况展开严格的调查,移民局有资格可以在过渡签证持有人在澳洲的各类行为取消其过渡签证!
