In some circumstances, officers may exercise their discretion to not require a 457 visa skills assessment from a visa applicant who would otherwise have been required under policy to do so. Officers may consider exercising this discretion if the visa applicant:

•      currently holds a 457 visa as a primary sponsored person and is currently employed in the nominated occupation in Australia or

•      holds the relevant Australian qualification (Certificate IV or above) for the nominated occupation, gained by studying in Australia or

•      holds a relevant qualification that is commensurate with the level indicated in ANZSCO for the nominated occupation and was gained by studying in a country that would not be subject to a 457 visa skills assessment normally or

•      holds the relevant Australian licensing/registration for the nominated occupation or

•      seeks to fill a nominated occupation which is an intra-company transfer and is currently employed in a similar occupation for the same company overseas.

Each case is to be considered on its merits. For example, even if a visa applicant meets one of the exemptions described above, it is still open to officers to require the visa applicant to provide a 457 visa skills assessment, if officers have bona fides concerns.

The occupation of Armature Winder is classified by ANZSCO as a specialisation of Electrician (General). Visa applicants who will be working as Armature Winders and would otherwise be required to complete a 457 skills assessment should be given the option of providing written evidence from the relevant licensing body of either holding the licence or their eligibility for licensing on arrival in Australia.

Where an applicant who would be required under policy to complete a 457 visa skills assessment provides evidence of having successfully completed one of the following types of skills assessments they should not be requested to also complete a 457 visa skills assessment:

•      Offshore Skills Assessment (OSAP)

•      Offshore Technical Skills Record (OTSR)

•      Job Ready Program – Final assessment

Conversely, TRA Migration Skills Assessments and Job Ready Provisional Skills Assessments are not acceptable as alternatives to the 457 visa skills assessment.

Australian Recognised Trades Certificates (ARTC) are issued for a specific purpose and are not acceptable to be used for migration purposes, therefore an ARTC also cannot be accepted as an alternative to the 457 visa skills assessment.

If an applicant submits any other alternative type of skills assessment, officers may seek advice from the Employer Sponsored Policy Section, National Office as to whether a 457 visa skills assessment is still required.
